Victims of a hospital patient records leak can be entitled to make a claim for compensation with us on a No Win, No Fee basis.
These kinds of leaks can easily happen, and we represent a lot of clients for cases of this nature. Given the wealth of personal and sensitive information that healthcare organisations store and process, any leak or misuse event can be serious.
Victims of a medical data breach can be entitled to claim for the distress caused by the loss of control of their personal information. When it comes to medical cases, the distress can be severe.
Compensation for a hospital patient records leak
Victims of a hospital patient records leak event can be entitled to make a claim for compensation with us on a No Win, No Fee basis.
Most hospital data leaks are the result of an accident or a so-called “human error” event. Commonly, these can include:
- Data being sent to the wrong patient by post or email;
- Information or documents found abandoned;
- Mass leak events, such as data being accidentally published online;
- Data disclosures without proper reason or authority.
In any of these cases, you could be entitled to make a legal case, and the GDPR allows victims of a breach to be able to claim compensation. We offer free, no-obligation assessments and we can represent victims on a No Win, No Fee basis for cases that we can take forward.
Medical data compensation claims
Medical data breaches such as a hospital patient records leak event can be quite common. In fact, when it comes to individual compensation cases, healthcare data breach compensation claims are one of the most common kinds of cases that we take forward.
When it comes to the dozens of different group and multi-party actions we’re involved with, some of the most serious ones are medical data leaks too. The 56 Dean Street Clinic email leak of 2015 is one of the most infamous examples. The more recent Charing Cross Gender Identity Clinic leak is another serious example. We know just how severe the impact for the victims can be given our experience in representing clients for these kinds of serious leak events.
Data breach compensation pay-outs for medical cases can often be quite high because this kind of information, when exposed or misused, can cause serious distress for the victims. It’s precisely the kind of data we want to maintain strict control of. Any loss of control over such information can be devastating.
West Suffolk Hospital data leak
A recent example of a hospital patient records leak involved a member of the public that reportedly found a bundle of confidential documents whilst walking their dog.
It’s understood that the bundle contained a list together with a doctor’s letter being found. This contained the information for 12 patients, including names, contact information, medical histories and notes about admissions. Some test results were also found with the bundle, which was found some 28 miles away from Bury St Edmunds Hospital.
It’s understood that the matter is now being investigated.
