Claim compensation for a leak of confidential documents
You could be entitled to pursue a privacy claim for compensation if you have suffered distress as a result of the leak of confidential documents. If the documents affected contained information about you that was sensitive, the GDPR could allow you to receive damages for the impact that such a data breach has had on you.
There can be many examples and many ways in which a data breach of this nature could arise. Some examples that could entitle you to pursue a claim can include:
- Documentation being sent to the wrong recipient(s).
- Data left exposed online or accessible to people that it should not have been accessible to which has then been accessed.
- Confidential documents shared without your consent or knowledge.
- A cyberattack that results in the theft and/or exposure of documents.
Ultimately, if you did not consent or expect documents about you to be used or shared in the way in which they have been, there may be a case to answer. You have the right to control who knows what about you, and if this control is taken away from you, it can be very upsetting and disturbing.
In such an event, the GDPR could entitle you to claim compensation for any impact that you have had to endure.
Recent example: Brent Council
In a recent example of a somewhat bizarre leak of confidential documents, Brent Council had to investigate a matter involving sensitive information ending up in people’s gardens and gutters.
Media reports suggested that the North London council suspended its refuse contractors Veolia after the documents fell off one of its trucks. This appears to be the rather simple – but potentially catastrophic – cause of the breach.
It is understood that the hundreds of documents involved included personal details and some information that would be classified as sensitive. Apologies have been issued and the matter has been reported to the UK’s data watchdog, the Information Commissioner’s Office (ICO). Hopefully, none of the data that has been affected has been misused as a result of the breach.
