NHS staff mishandling medical records: in the media
In an exclusive from Mark Tovey for the Mail Online, Freedom of Information data reportedly revealed that more than two staff a day are mishandling medical records. This is an issue that we have talked about a lot, and these issues have previously resulted in the UK’s data watchdog, the Information Commissioner’s Office (ICO), issuing blanket warnings to those working in the healthcare sector.
As leading Data Leak Lawyers, we take on a lot of cases for these kinds of medical data breach compensation claims. As such, we were not surprised at all to see the results of the findings, and it is vital to get this data out.
The article goes on to confirm that Leeds teaching Hospitals reportedly had the highest number of incidents involving staff snooping on medical records. It also cited staff at Acute and Mental Health Trusts, “disciplined 652 times over two years for breaching patient privacy, with many incidents involving nosey employees looking up medical records of friends, family, colleagues and neighbours”.
The high-profile cases that we have previously discussed involving Sir Alex Ferguson and Ed Sheeran are also covered, and we are grateful for the citation in the article.
What can be done about these issues?
It is clear to us that much more needs to be done to prevent employees from mishandling medical records, whether by engaging in snooping, losing data, or inaccurately recording information. Our medical records are so important, and they must be accurate and detailed to help us in our times of need. Equally, they contain some of the most personal and sensitive information that there can be about us, so they must be treated with respect. We cannot have staff curiously looking at the personal and sensitive special category data of people without any good reason to do so.
A victim of an event involving mishandling medical records could be entitled to claim data breach compensation. The GDPR can entitle you to receive damages for any distress that you have suffered from that is caused by the loss of control of your personal information. Since medical data is some of the most sensitive that there is, data breach compensation pay-outs and amounts can be substantial in these cases.
