You could be entitled to claim privacy compensation on a No Win, No Fee basis if your medical notes have been involved in a breach, leak or a hack. Not only are you entitled to the right to privacy in accordance with the GDPR, healthcare information can also be afforded additional protection as it can be classed as “special category” information. The reason for this additional protection is because of the sensitivity of medical data in particular, as the law recognises that this is exactly the kind of information that we want strict control over.
If your medical notes have been involved in an incident and you have lost control over your right to privacy as a result, you could be entitled to claim compensation. The GDPR can allow victims of a data breach to recover damages for any distress that has been caused by the loss of control of their personal information, which can be substantial when it comes to healthcare data. In fact, we have settled many cases for over £10,000 in damages that have involved the exposure or misuse of healthcare information.
The best place to start to find out if you could be entitled to pursue a case is to contact our team for free, no-obligation legal advice here now.
There has been another news story reported in the media about medical records being found dumped that contained incredibly sensitive and personal information, including healthcare data.
In this particular incident, it is understood that a jogger reportedly found dumped medical information that was related to the Royal Shrewsbury Hospital. It is worrying that this is not the first incident of its nature in which medical notes have been found in locations that they should not have been, or have been found abandoned somewhere.
There have been plenty of NHS data breaches since 2017, with one of the notable incidents of that year being the WannaCry cyberattack that caused serious disruption to our national healthcare service. There was also the NHS Digital incident of which we launched a group action for, and there have been a number of individual incidents that we have helped people pursue damages for as well.
Unfortunately, the coronavirus pandemic resulted in additional strain on resources in respect of our national healthcare service, and government policy in respect of resourcing has also not helped. If there is ever a lack of focus on privacy, this could easily result in avoidable data breaches occurring, which is something that must be stopped to prevent people from losing control of their personal information.
