Compensation for data breaches from phishing emails

You could be eligible to claim compensation for data breaches from phishing emails and attacks where they are successful and your information has been misused or exposed.

The GDPR means that our rights are enshrined in law in terms of our information being protected, and our right to control over it. If the GDPR is breached, that is when an organisation can be negligent and, therefore, can be responsible to compensate a victim for what has happened.

Stor-A-File cyberattack: information dumped on the dark web

It has been reported that the recent Stor-A-File cyberattack resulted in hackers demanding a ransom of three million pounds in Bitcoin which has reportedly been rejected, leading to data being exposed online.

Last week, we covered the issues facing the Lister Fertility Clinic who are understood to have written to some 1,700 patients over medical records that Stor-A-File had been providing scanning services for. With potentially sensitive medical information at stake, it had been feared that patients of the clinic could be vulnerable to their private and sensitive medical information being compromised.

Now, it has been reported that the worst looks to have happened and that private and sensitive data stolen in the attack has now been put onto the dark web.

Billions of leaked records – data exposure in 2021

According to a recent report, over five billion personal records have already been exposed in 2021. A number of significant data leak incidents have contributed to the billions of leaked records, showing how cybercriminals are often able to steal information in large quantities.

In many cases, the theft of records can be facilitated by the negligence or errors of data controllers. Despite being required by law to impose strong cybersecurity defences, vulnerabilities are often neglected and left open for cybercriminals to take advantage of.

Your Lawyers, as leading specialists in data protection law, have seen data controllers fail to meet their responsibilities on many occasions, and the consequences can be devastating for those affected. It is not always possible to undo the impact when control of your personal information is lost, but making a data protection breach compensation claim can allow you to hold a third-party organisation accountable for any failure to protect your personal data. In a time in which so many records are being leaked, our work has never been more important.

Twitch earnings data leak exposes wealth of information

The Twitch earnings data leak has reportedly led to a wealth of personal information about streamers being exposed and being circulated online.

It is not yet fully clear as to exactly how the information has been exposed. There are reports that hackers have claimed responsibility, and the Amazon-owned platform has reported a “server configuration” problem.

As leading data breach compensation lawyers, what we do know for sure is that the personal information for a lot of people has been exposed. What this means is that they could be entitled to claim data breach compensation with No Win, No Fee legal representation.

Human errors and cyberattacks – advice for victims

Many fall into the trap of regarding human errors and cyberattacks as distinct causes of data breaches but, in many cases, they can be closely linked. In fact, human errors can leave data controllers vulnerable to cyberattacks. Where private information has been unjustly put at risk, the organisation responsible may have breached data protection law.

Unfortunately, third-party data controllers may try to blame their negligence on the increasing sophistication of cybercrime, but we believe that they must be held accountable for any mistakes. If you have fallen victim to a data breach as a result of the actions of a third party, you may be entitled to claim compensation for the harm caused.

Neither human errors nor cyberattacks should be brushed to the side as unfortunate accidents, and you deserve justice for the exposure of your personal data. Your Lawyers, as leading Data Leak Lawyers, are here to help you now.

Data leaks from outsourcing

For businesses with expanding opportunities and responsibilities, it often becomes necessary to hire external providers and suppliers to ensure the efficiency of company operations. Data leaks from outsourcing can unfortunately occur when these external providers lapse in protecting the information held by the company they work with.

However, when a data leak does arise, it is not acceptable for the affected company to simply shift the blame onto an external supplier or provider. Ultimately, the responsibility to protect the information of customers, members and employees falls on the organisation itself as a result of the legal duties that they must adhere to. Even in cases where an external provider caused the leak, the victims can still be eligible to claim compensation either way.

Online shopping scams

In September, a study by Finder reportedly found that online shopping scams had increased by over a third in the first half of 2020.

The national lockdowns resulting from the Covid-19 pandemic have frequently been singled out as the reason for this notable rise in cases, which comes as no surprise. As such, it is also unsurprising that further waves of online shopping scams may continue as we enter the second month of the latest national lockdown in England.

Indeed, the figures in the Finder report suggested that online shopping and auction scams accounted for around two-thirds of fraud reported by consumers in 2020. Clearly, the threat of online shopping scams cannot be underestimated.

British Airways data breach settlement could lead to £2.4bn pay-out

As pressure mounts on the airline, a British Airways data breach settlement is on the cards as the legal representatives of BA alert the court of their intentions to engage in negotiations.

The breaking news of this development comes from leading consumer action and data breach firm Your Lawyers, with wide coverage so far with major media outlets including The Sun and The Mirror. Your Lawyers, who sit on the Steering Committee responsible for the overall conduct of the litigation, declare that this is a massive step forward. This could signal the start of the end of the action that is now entering its third year, and it could represent an incredibly significant compensation pay-out bill that could reach up to £2.4 billion to be shared between over 400,000 victims if all initiate a claim.

The announcement signifies what we always believed should have been on the horizon. A settlement could effectively draw a line under the serious 2018 data breach that shocked the world. We urge victims who have yet to claim to come forward to start their case before the deadline to claim expires soon.
